Gifting a Car in Oklahoma: What It Really Costs

Oklahoma's gift exemption is narrower than most people assume. Only two relationships qualify for a fully tax-free transfer: spouse to spouse, and parent/stepparent to child/stepchild, and only when no money or other consideration changes hands. File the Family Affidavit (Form 794) for one of those relationships and both the 3.25% excise tax and the 1.25% sales tax disappear - you still pay the $11 title fee and $17 transfer fee, but that's it.

Overview

Give the same car to a sibling, grandparent, cousin, or friend and Oklahoma doesn't see a qualifying gift at all. The 1.25% sales tax still drops away, because no actual sale occurred, but the excise tax does not - the state assesses the vehicle's value and charges 3.25% (or the $20-plus-3.25%-above-$1,500 used-vehicle formula) exactly as if it had sold for that amount. A bill authored in the 2026 session to extend the exemption to grandparents has passed the House but is not yet law.

Oklahoma gift a car FAQ

Who qualifies for a tax-free vehicle gift in Oklahoma?

Only spouses transferring to each other, and parents or stepparents transferring to children or stepchildren (in either direction), with no payment involved. File Form 794 to document it. Siblings, grandparents, aunts/uncles, and friends do not currently qualify for the excise-tax exemption.

What does it cost to gift a car to my child in Oklahoma?

$28 total - the $11 title fee and $17 transfer fee. With Form 794 on file, neither the 3.25% excise tax nor the 1.25% sales tax applies at all.

What if I give a car to my adult sibling instead?

The sales tax still doesn't apply, since no sale took place, but the excise tax does - Oklahoma assesses the vehicle at its value and taxes it as though it changed hands for that amount (3.25% of the value, or $20 plus 3.25% above $1,500 if it's a used vehicle). Plus the standard $11 title and $17 transfer fees.

Can grandparents gift a car tax-free in Oklahoma?

Not yet. A bill to extend the family excise-tax exemption to grandparents and grandchildren passed the Oklahoma House in the 2026 session but had not become law as of this writing - check current status with Service Oklahoma before assuming it applies.

Is Form 794 mandatory even between spouses?

Yes - without a completed Family Affidavit on file, the licensed operator has no way to know the transfer was a qualifying gift and will assess excise tax on the vehicle's value by default.

Does a gifted car still need a lien check?

If the vehicle being gifted has an existing loan, the lien has to be released before the title can transfer - gifting doesn't erase debt attached to the car. Once released, the transfer proceeds as a normal gift.
